Waiver and Liability Agreement

 

Warning: By agreeing to this document, you are waiving certain legal rights, including the right to pursue legal action against the Organization. Please read carefully.

 

 

1. Definitions

In this agreement:

Organization refers to Elite North Soccer Inc., including its directors, officers, employees, contractors, Game Facilitators (including but not limited to non-certified referees), volunteers (including but not limited to Parent Coaches), agents, and representatives.

Activity/ Activities refers to all programming, sessions, events, and operations conducted, organized, or facilitated by the Organization, including but not limited to:

  • Games (including small-sided games).

  • Any on-field or off-field programming.

  • Use of indoor or outdoor facilities (including turf, grass, or gym surfaces).

  • Any related event, gathering, or interaction connected to the Organization.

Player refers to the registered child/ player that is partaking in the key Activities of the event.

Parent/ Guardian refers to the parent or legal guardian of a Player or Participant who is responsible for registration, decision-making, and supervision.

Participant(s) refers to any individual involved in, attending, or participating in Activities. This includes, but is not limited to: Players; Parents/ Guardians; Spectators; Coaches (including Parent Coaches; Game Facilitators; Volunteers. The term “Participant” applies whether the individual is actively participating or simply present at an Activity.

Accompanying Participants refers to any Participant that is attending the event, who is considered to be accompanying another participant. This includes but is not limited to Parents/ Legal Guardians. 

 

 

2. Parent/ Guardian Responsibility

I confirm that:

  • I am the parent or legal guardian of the Player.

  • I have full legal responsibility for the Player’s participation.

  • I have legal authority to make decisions on their behalf.

  • I am responsible for decisions made on their behalf.

 

 

3. Acknowledgement of Activities

I acknowledge that participation includes, but is not limited to:

  • Small-sided soccer games (including but not limited to games of 3 vs 3).

  • Rotating match formats.

  • Training exercises, warm-ups, and gameplay.

  • Use of indoor and outdoor facilities (including but not limited to turf, grass, and gym surfaces).

  • Interaction with Players, Participants, and representatives of the Organization.

  • Activities included in Definitions above.

 

 

4. Acknowledgement and Assumption of Risk

I understand and acknowledge that participation in the Activities involves inherent, foreseeable, and unforeseeable risks, including but not limited to:

Physical Risks

  • Collisions with other Players and/ or Participants.

  • Collision with representatives of the Organization.

  • Contact with balls, equipment, or surfaces.

  • Falls, slips, trips, and rapid changes in movement.

  • Risk of concussion or other serious injury.

Environmental Risks

  • Uneven or unsafe playing surfaces.

  • Indoor and outdoor conditions (including but not limited to weather).

  • Facility-related hazards.

Organizational Risks

  • Supervision by volunteer Coaches (including but not limited to Parent Coaches)

  • Use of Individuals and Game Facilitators that are not certified referees, who are responsible for observing and facilitating games.

  • Possible errors in judgment, instruction, facilitation, or supervision.

General Risks

  • Negligence of other Participants.

  • Negligence of parents or individuals that are supervising Participants.

  • NEGLIGENCE ON THE PART OF THE ORGANIZATION, including but not limited to failure to safeguard or protect Participants.

I acknowledge that these risks may result in serious injury, permanent disability, or death.

I confirm that:

  • The Player/ Participant is participating voluntarily.

  • I understand and accept all such risks on behalf of the Player/ Participant.

 

 

5. Participant and Parent Responsibilities

I agree that:

  • The Player/ Participant is physically and mentally able to participate.

  • The Player/ Participant will follow all rules, instructions, and policies.

  • I will follow all rules, instructions, and policies.

  • I am responsible for the Player/ Participant’s conduct and supervision where applicable.

  • I will ensure the Player/ Participant acts safely and within their abilities.

  • I will remove the Player/ Participant from participation if unsafe conditions arise.

  • I am responsible for providing and maintaining appropriate equipment for the Player, including but not limited to shin pads and appropriate footwear.

 

 

6. Release of Liability

In consideration of the Organization allowing the Player/ Participant to participate in the Activities, I agree:

  • To WAIVE ANY AND ALL CLAIMS that I, the Player/ Participant, or any related party may have now or in the future against the Organization.

  • To RELEASE the Organization from any and all liability for any injury, loss, damage, expense, or death arising out of or related to participation in the Activities.

This includes, without limitation:

  • NEGLIGENCE;

  • GROSS NEGLIGENCE;

  • breach of duty of care;

  • failure to safeguard or protect;

  • errors, omissions, or failure to act by the Organization.

 

 

7. Indemnification

I agree to INDEMNIFY AND HOLD HARMLESS the Organization from any and all claims, damages, losses, or costs (including legal fees) arising from:

  • The Player/ Participant’s actions or omissions.

  • My actions or omissions.

  • Failure to comply with rules, policies, or instructions.

 

 

8. No Reliance

I acknowledge that:

  • I am not relying on any verbal or written statements, representations, or assurances made by the Organization.

  • I have made an independent decision to allow the Player/ Participant to participate.

 

 

9. Medical Consent

I authorize the Organization or other Participants to seek emergency medical assistance for the Player/ Participant if necessary.

I acknowledge that:

  • The Organization does not provide medical care.

  • The Organization does not provide medical services or insurance coverage. Any assistance provided is voluntary and provided without liability.

 

 

10. Equipment & Facilities

I accept all risks associated with:

  • Use of facilities (indoor and outdoor).

  • Use of equipment provided by the Organization.

 

 

11. Property

The Organization is not responsible for:

  • Lost, stolen, or damaged personal property

 

 

12. Jurisdiction

This agreement shall be governed by the laws of the Province of Ontario, Canada.

This agreement is intended to be as broad and inclusive as permitted by the laws of the Province of Ontario. Any ambiguity shall not be interpreted against the Organization.

Any legal action must be brought exclusively in Ontario, Canada.

 

 

13. Severability

If any portion of this agreement is found unenforceable, the remaining sections shall remain in full force and effect.

 

 

14. Image Release

I grant permission for the Organization to photograph and/or record the Player and all Participants for promotional purposes, without compensation.

 

 

15. Acknowledgement & Binding Effect

I confirm that:

  • I have read and understand this agreement.

  • I am signing voluntarily.

  • I accept the risks on behalf of the Player/ Participant.

  • This agreement is binding on myself and my heirs, guardians, next of kin, and legal representatives.
